1. iNtroDUCtioN
the linking directive,2 an amendment to the Et Directive,3 creates the possibility
for companies covered under the European Union Emissions trading scheme
(EU Ets) to use the credits obtained through the project-based mechanisms of
the Kyoto Protocol for compliance along with EU allowances.4 this chapter
gives an analysis of this linking directive. First, a survey of the evolution of the
EU position on the acceptability of the so-called flexible mechanisms within
the Kyoto Protocol is given, to highlight the challenges present in the negotia-
tions leading to the linking directive, and to understand the challenges lying
ahead. then, a brief review of the European Climate Change Programme will
follow. the third part focuses on the analysis of the main provisions of the Di-
rective. to conclude, the main challenges are presented in summarized form.
