Abstract/Description:
EU competition law and the competition laws of the Member States have for decades been developing alongside one another with little interaction. This has fundamentally changed when Regulation 1/2003 entered into force on 1 May 2004 introducing a new enforcement system of Articles101 and 102 TFEU. In fact, Regulation 1/2003 has, for the first time, introduced a governance framework for the relationship of EU and national competition laws. This governance framework is characterized by a specific dynamism resulting from the decentralized enforcement of EU competition law and the parallel application of national competition laws. This relationship is also subject to the ongoing harmonization process between the competition laws of the Member States and that of the EU.
