Abstract/Description:

In the theory and practice of advancing the innovation of social management by the Chinese People's Court, parties in several cases have become more skeptical of the People's Court's legitimacy to participate in 'social management innovation' and have also been concerned about extensive exploration of wide practice methods, mechanisms, and boundaries of SMI by the courts. For example, Dong Kaijun, the president of the Higher Court of Qinghai, emphasized five problems of social management innovation, as follows: '1) dealing with all kinds of cases; 2) administering Complaint Letters and Visits effectively; 3) establishing and improving the system of dealing with justice risk management; 4) improving the judicial suggestion system; and 5) strengthening Court management'.
