Abstract/Description:

The law stands between food availability and food entitlement. Starvation deaths can reflect legality with a vengeance. This chapter focuses on the role the European Union’s (EU) Common Agricultural Policy (CAP) can play for the realization of the Millennium Development Goals (MDGs) in general and the specific target to reduce hunger in particular. It starts with a brief description of the MDGs, their historical and diplomatic background, the institutional structure put in place to pursue their implementation and current assessments about their chances of attainment by the target date of 2015. Section 3 will then look at the hunger reduction target in particular against the background of the established human right to adequate food, approaching the issue from the perspective of whether or not the MDGs impose any legal obligation at all and whose duty it is to ensure their realization. Section 4 provides an overview of the CAP, focusing on its implications for international trade in food products and attempts to answer the question of whether or to what extent the CAP contributes, directly or indirectly, towards attainment of the MDG1 target on hunger reduction. Section 5 concludes with a summary of its findings.
