Abstract/Description:
The possible availability to Ombudsmen of exercising their own-initiative powers has a number of notable theoretical advantages, which are broadly analysed in this chapter. Have Ombudsmen been able to exploit to the full the theoretical advantages that conducting their own-initiative inquiries offer? Based on the analysis of the work undertaken by 11 Ombudsmen – recognized representatives of distinct institutional models and of different parts of the globe, the answer can only be affirmative. This overall conclusion is based on the matters that have been addressed in these own-initiative investigations, the motives for which they have been instigated and the activities they have deemed it appropriate to include in these inquiries, such as inspections and the promotion of modifications to the legislation.
