Abstract/Description:
The chapter follows and discusses the developments regarding the human right to water and sanitation through the declarations of various global meetings and conventions, since the 1970s. It traces the evolution of the Committee on Economic, Social and Cultural Rights from an ad hoc sessional working group to a full-fledged Committee (the Committee), akin to the Human Rights Committee established under the International Covenant on Civil and Political Rights. The chapter then provides a thorough analysis of the right to water and sanitation pronounced by the Committee in 2002 in its General Comment No. 15, the resolutions of both the United Nations General Assembly in July 2010, and the Human Rights Council in September 2010. Based on this analysis, the chapter concludes by affirming that there exists today a human right to water and sanitation under international law, and by highlighting the various challenges facing the realization of such a right.
