Abstract/Description:

This chapter is a synthetic commentary to Article 49 of the Energy Charter Treaty (ECT) comprising two sections, respectively covering its purpose and its content. The mentioned Article defines which Party shall be the depositary of the Treaty. Accordingly, this commentary focuses on the role and functions of depositary States under public international law, as it has been enshrined in the 1969 Vienna Convention on the Law of the Treaties, thus framing Article 49 within the broader international law context in an evolutionary perspective.
