Abstract/Description:

Although Mexico’s civil law tradition is based in the French Civil Code, there are unique and special aspects to consider when engaging in a copyright licensing agreement in Mexico. This chapter provides an overview of the copyright legal spectrum in Mexico, details the contractual requirements for a license to be valid and enforceable, the special formalities when contracting copyright protected content, an in-depth consideration of the copyright applicable laws, regulations and legal precedents; jurisdictional aspects, tax considerations as well as a thorough section on anti-trust matters.
