Abstract/Description:

This chapter locates product safety regulation by public authorities in relation to private law mechanisms (especially product liability law) and market forces (reputational effects) in promoting product safety. It compares the historical development of both pre- and post-market regulatory interventions. The main focus is on the US (an early pioneer), then the EU (slow and steady), Japan (reaching for the global standard) and Australia (the odd one out, until recently), as well as other developments in the Asia-Pacific region along with the impact of global governance mechanisms such as the WTO. Overall, the chapter finds re-regulation among deregulation in the field of consumer product safety.
