Abstract/Description:
This chapter examines the legal status of the other party to the contract of carriage – the shipper – and its corresponding duties and liabilities. The explicit inclusion of the shipper’s duties in the Rotterdam Rules has important practical implications when carriage is performed on a maritime plus basis. In such transportation, the conventional role of a shipper changes. Moreover, the novel concept of ‘documentary shipper’ introduced by the Rotterdam Rules can encompass a wide range of persons, including those who operate in the area of multimodal transportation. The chapter also briefly discusses another novelty of the convention, that is, the concept of ‘volume contracts’. This concept, previously unknown in international convention regimes, is now governed by the Rotterdam Rules. The essence of it is that when there is a separately negotiated contract between the shipper and the carrier, special rules will apply.
