Abstract/Description:
This chapter examines developments in death penalty law and practice in China. It reviews law and practice in light of China’s domestic political context. It is organised around four main themes concerning some of human rights-related issues in the UN Safeguards Guaranteeing Protection of the Rights of Those Facing the Death Penalty. These include: imposing the death penalty only for the ‘most serious crimes’; ensuring that evidence leaves no room for an alternative explanation of the facts; ensuring a fair trial though final judgment safeguards; and providing alternative pathways for commutation of death sentences.
