Abstract/Description:
This chapter explores the impact of copyright pluralism and harmonisation on those human rights of the visually impaired persons that are dependent on access to copyright works. The chapter focuses on the role of copyright flexibilities in provision of equal and timely access to copyright protected material for the blind and visually impaired. The chapter argues that while pluralistic approaches to regulating copyright flexibilities are unavoidable because of states’ differing circumstances, a degree of normative harmonisation is necessary to safeguard the visually impaired persons’ fundamental rights. Furthermore, the chapter highlights that those aspects of copyright flexibilities that are not harmonised need to be approached in a manner consistent with the protection of human rights of the visually impaired. The chapter argues that this can be best achieved through the creation of a human rights framework for copyright law to the extent that it affects the visually impaired persons’ access to copyright works.
