Abstract/Description:
Despite the approximation of national copyright laws through international treaties and European Union directives, different philosophies underpinning the continental and common law systems are still visible. Varying legal approaches is one reason why the further harmonisation of copyright law norms has largely been focused on the protection of works and author’s rights, such as the right to control the reproduction, public distribution, adaptation, or public performance, and not on the exceptions and limitations. The Marrakesh Treaty may indicate a slow evolution of the copyright law towards a more pluralistic regime of copyright protection, meaning protection not only of authors, but also of other participants in copyright system, including users. This chapter discusses the main assumptions and consequences of the adoption of the Marrakesh Treaty by the international forum, both for the beneficiaries of the act, authors and the copyright system.
