Abstract/Description:

This chapter contributes to an understanding of the African regional refugee protection instrument - the 1969 OAU Convention Governing the Specific Aspects of Refugee Problems in Africa. As its full title makes clear, the 1969 Convention is intended to deal with those aspects of the refugee problem that are particular to Africa and are not adequately addressed by the 1951 Refugee Convention. This chapter outlines some of the 1969 Convention’s distinctive features, such as its expanded definition of a ‘refugee’, strengthened protections for refugees, and acknowledgement of the links between refugee protection and state security. This chapter also explores the 1969 Convention’s significance for the future of refugee law, including its adaptability to changing contexts and causes of displacement and its implementation in practice within African states.
