"The chapter 7 trustee" [2019] ELECD 2087; in Lubben, Stephen (ed), "American Business Bankruptcy" (Edward Elgar Publishing, 2019) 83

Book Title: American Business Bankruptcy

Editor(s): Lubben, Stephen

Publisher: Edward Elgar Publishing

Section: Chapter 8

Section Title: The chapter 7 trustee

Number of pages: 4

Abstract/Description:

Every chapter 7 case has a trustee. Some may have several trustees during the life of the case. The chapter 7 trustee assigned on the day the case is filed will normally come from the panel of trustee’s standing ready for such cases. In many instances, that interim trustee will remain in place throughout the case. But in cases involve sizable assets, including cases converted from chapter 11, the creditors might consider it worthwhile to appoint a different trustee. Whoever is appointed, will play the key role in gathering the debtor’s assets and selling the same for the benefits of the creditors.
