Abstract/Description:
One of the trustee’s key duties is to liquidate the estate’s assets and distribute the proceeds to creditors. The Code provides clear guidance for the final distribution of the estate, but there are several ways that creditors, particularly secured creditors, may receive a distribution earlier than other creditors. For example, the trustee may have abandoned property under section 554 or otherwise distributed under section 725 to somebody else with an ownership interest in the property.
