Editor(s): Saidov, Djakhongir
Publisher: Edward Elgar Publishing
Section: Chapter 9
Section Title: CIF and FOB contracts in English law: current issues and problems
Author(s): Bridge, Michael
Number of pages: 27
Abstract/Description:
This chapter surveys the field of export sales governed by English law and concluded on CIF or FOB terms. It focuses on the sale of commodities and takes account of the volatile conditions in which such contracts are concluded and which shape the law in this area. The chapter does not provide a full account of the law but instead selects a number of issues that have attracted litigation in modern times and that convey the spirit of the modern law. For example, the chapter scrutinises the relations between FOB contracts and charterparties and examines the nature of string trading and how it affects the performance of CIF contracts.
