Abstract/Description:
This chapter surveys the emerging field of religious feminist jurisprudence and explores how law and religion theory shaped by feminist insights might approach common problems in law and religion from a different perspective than mainstream law and religion theory. It focuses on the ways in which feminist theorists describe the nature of reality, including the effects of male–female power relations; feminism’s understanding of religious liberty; and the role of the state in seeking justice for women. It applies these arguments to two current controversies: the debate over religious women’s right to wear so-called modest clothing in public settings, and the problem of domestic violence in religious communities.
