Abstract/Description:
This chapter provides commentary on art. 24 of the CRC on the right of the child to the enjoyment of the highest attainable standard of health. The chapter focuses on obligations for children’s right to health, exploring the issues of progressive realisation, retrogressive measures, minimum core obligations and international cooperation as well as looking into special issues of concern such as infant and child mortality, medical assistance, malnutrition, pre- and post-natal care, family planning and so-called harmful traditional practices. In this context, the chapter also looks into the case law of the European Court of Human Rights and the CRC Committee with respect to migration applications based on fears of female genital mutilation/cutting at countries of origin. Finally, the chapter addresses contemporary debates around medical consent and the obligations of private actors.
