Abstract/Description:
This chapter provides commentary on art. 34 of the CRC on the protection of children from sexual exploitation and abuse. The chapter investigates the definitions of sexual exploitation and abuse, including the definitions adopted by the UN, the WHO and the Interagency Working Group on Sexual Exploitation of Children (Luxembourg Guidelines). The chapter focuses on the obligation of protection and prevention in light of the CRC as well as other legal instruments such as the Council of Europe (CoE) Convention on Protection of Children against Sexual Exploitation and Sexual Abuse (the ‘Lanzarote Convention’) and the European Union Directive 2011/92/EU on combating the sexual abuse and sexual exploitation of children and child pornography and relevant case law. The chapter also problematises the widespread use of information and communication technologies (ICT) in the context of art. 34 CRC.
