Abstract/Description:
The implementation of the WIPO Treaties of 1996, namely the WIPO Copyright Treaty (WCT) and the WIPO Performances and Phonograms Treaty (WPPT), is one of the objectives of Directive 2001/29/EC. This chapter sets the scene for the following chapters of this book by dividing the international obligations arising from the Treaties which are to be implemented by the EU and its member states into implementation issues with a high, medium and low level of discretion left to the individual legislator. In addition, the chapter gives a brief overview of developments which have occurred at the international level since the adoption of the WIPO Treaties over 20 years ago, including the Beijing and the Marrakech Treaties as well as the discussions taking place in the context of the Standing Committee of Copyright and Related Rights (SCCR) at WIPO. Moreover, a particular focus is put on balancing issues and the relationship of copyright and human rights.
