Abstract/Description:
Austrian copyright law exhales the blandness of the average suburban front lawn: it is cared for but you will not see any exciting horticultural experiments or too flashy decorations. The legislative gardener is dutifully keeping everything in shape, giving the mildly interested neighbours no reason to tattle. It therefore comes as no big surprise that the implementation of the Directive into Austrian copyright law is dutiful and sufficient. Minor criticisable or debatable points remain with the non-implementation of the three-step test and the incomplete rules on technological protection measures. While the system of exceptions and limitations is starting to look a bit overgrown and could use some weeding and trimming, the question of the lawful source for private copying was resolved as were the insecurities regarding the collection and distribution of (millions of) levies.
