Abstract/Description:
In Finland the implementation of Directive 2001/29/EC did not have any major impact on the scope of author’s rights whereas the exclusive rights of related rights holders (except database makers) were broadened to cover the communication to the public right in respect of on-demand services that is, the interactive making available right from Article 3(2) of the Directive. Likewise, the implementation did not have any major impact on limitations and exceptions to the rights. New provisions on extended collective licensing were however introduced on a national basis. The major problems after the implementation have concerned enforcement of rights in cases were infringers are unknown. There are provisions on disclosure of identification data of certain IP numbers and measures to be taken against intermediary service providers. The recent case law however shows that enforcement of rights is still rather difficult.
