Abstract/Description:
The chapter on Ireland describes the scheme of the Copyright and Related Rights Act 2000 (as amended) and the manner in which it transposed Directive 2001/29/EC. It looks at the way in which the rights of reproduction, communication to the public and distribution are framed, and measures the exceptions and defences to infringement in the Act against the exceptions and limitations permitted by Article 5 of the Directive. The chapter tracks a series of enforcement cases brought by the music industry over a decade, leading to the ready availability of ‘blocking injunctions’ and, uniquely in Europe, the imposition by court order of a ‘graduated response system’ to be followed by internet service providers, to help combat infringement in the online environment. The conclusion is drawn that the Irish courts now have a robust and settled response to infringement claims.
