Abstract/Description:
The chapter describes three steps in which the Directive 2001/29/EC was implemented into the Polish legal system. It concentrates on the newest development, i.e. Copyright Amendment Act of 2015 (‘2015 Amendment’). One will find in the chapter a detailed description of the Polish regulations on the reproduction right; the communication to the public/making available right; exhaustion of rights in the online environment. The essential part of the chapter consists of the elucidation of all limitations and exceptions to copyright and neighbouring rights regulated in the Polish Copyright Act, including private use and other public use exceptions. The next part is dedicated to regulations on technological measures and the last part to rights-management information.
