Abstract/Description:

This chapter introduces the book’s research question of when, and under which conditions, access to information can be granted under EU competition law. It does so by pointing out the important changes that occurred in society in relation to an increased dependence on information and how it affect the economy. It also stresses that the ‘conventional’ analysis of abuses of dominance, which could be defined as that which is applied to bricks-and-mortar businesses, has undergone some significant changes as the law on abuse in Europe does not seem to be apt to address abuses that concern access to information. Finally, it evaluates whether situations where companies that can be considered as unavoidable trading partners, which may enable them to manipulate information and possibly exclude or damage effective competition, should be forbidden per se, and should new kinds of abuses of dominance be introduced to accommodate the environment of digital markets.
