Chapter 1 sets forth the analytic framework for law and society in China. To provide two working definitions for in-depth discussion, the chapter first outlines the relevant sociological and jurisprudential scholarship on ‘society’ and ‘law’, then introduces the major law-and-society theories (including the evolution theory, functionalism, instrumentalism and critical legal theories), and finally explains the Chinese law in context.
