Complaint: Australian Nuclear Scienceand Technology Organisation (Cth)

Australian Privacy Commissioner, Cl 685(P), 1994 Privacy Act 1988 (Cth) - disclosure of identities of signatories of 'visitors book' - IPP 11

ANSTO disclosed address details of persons who visited its nuclear reactor facility to a private group which was in favour of nuclear facilities. The group then sent the complainant a circular requesting support. The complainants considered that a note on the 'visitors book' concerning the sending of further information could only be considered to refer to further information to be sent by ANSTO itself

The Commonwealth Ombudsman investigated a range of issues, with the Privacy Commissioner only becoming involved in order to seek a satisfactory resolution of the privacy issues on the basis of an apparent breach of IPP 11. ANSTO apologised formally to the complainant, issued an ANSTO general order requiring all staff to have regard to the Information Privacy Principles and conducted training courses with input from the Commissioner's Office. The Commissioner decided not to investigate further (s 41(2)(a)).
