1 Short title

This Act is the Hazardous Waste (Regulation of Exports and

Imports) Levy Act 2016.

(1) Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

3 Act to bind Crown
13
This Act binds the Crown in right of each of the States, of the
14
Australian Capital Territory and of the Northern Territory.
15
However, it does not bind the Crown in right of the
16
Commonwealth.

4 Act extends to external Territories
18
This Act extends to every external Territory.

5 Definitions

In this Act:

hazardous waste permit application means an application under
3
section 12, 13 or 13A of the Hazardous Waste (Regulation of
4
Exports and Imports) Act 1989.
5
indexation day means 1 July 2018 and each later 1 July.
6
index number, for a quarter, means the All Groups Consumer
7
Price Index number that is the weighted average of the 8 capital
8
cities and is published by the Australian Statistician in relation to
9
that quarter.
10
March quarter means a period of 3 months starting on 1 January.
11
property of any kind belonging to a State has the same meaning as
12
in section 114 of the Constitution.

6 Act does not impose tax on property of a State
14
This Act does not impose a tax on property of any kind belonging
15
to a State.

7 Imposition of levy

Levy is imposed on a hazardous waste permit application.

8 By whom levy payable
6
Levy imposed on a hazardous waste permit application is payable
7
by the applicant.

9 Amount of levy

(1) The amount of levy imposed on a hazardous waste permit
10
application is:
11
(a) $4,616; or
12
(b) if another amount not exceeding $6,000 is prescribed by the
13
regulations--that other amount.
14
(2) However, if the indexation factor for an indexation day is greater
15
than 1, the amount of the levy is, on that day, replaced by the
16
amount worked out using the formula:

(3) The amount worked out under subsection (2) is to be rounded to
19
the nearest dollar (rounding 50 cents upwards).

(4) The indexation factor for an indexation day is the number worked

base March quarter means the last March quarter before the

reference March quarter.

reference March quarter means the last March quarter before the
4
indexation day.

(5) The indexation factor is to be worked out to 3 decimal places
6
(rounding up if the fourth decimal place is 5 or more).

Index numbers
8
(6) Subject to subsection (7), if at any time before or after the
9
commencement of this section:
10
(a) the Australian Statistician has published or publishes an
11
index number in respect of a quarter; and
12
(b) that index number is in substitution for an index number
13
previously published by the Australian Statistician in respect
14
of that quarter;
15
disregard the publication of the later index number for the purposes
16
of this section.

(7) If, at any time before or after the commencement of this section,
18
the Australian Statistician has changed or changes the index
19
reference period for the Consumer Price Index, then, for the
20
purposes of applying this section after the change took place or
21
takes place, have regard only to index numbers published in terms
22
of the new index reference period.

10 Regulations
24
The Governor-General may make regulations for the purposes of
25
paragraph 9(1)(b).
