  This Act is the 

Migration Amendment (Common Sense Partner

Visa) Act 2020

(1)  Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

(4)  Despite any provision of the regulations, an application for a visa 

6 

referred to in the regulations as a Subclass 309 (Partner 

7 

(Provisional)) visa may be granted whether the applicant is inside 

8 

or outside Australia. 

9 

 

(5)  Subsection (4) applies in relation to a visa granted during the 

10 

period beginning the day this subsection commences and ending on 

11 

31 December 2021, whether or not the application for the visa was 

12 

made before or after the commencement of this subsection.
