                   Broadcasting Legislation Amendment (Anti-Siphoning) Bill 2010

Outline

The Broadcasting Legislation Amendment (Anti-Siphoning) Bill 2010 (the bill) amends the
Broadcasting Services Act 1992 in the following ways:
·   it removes the expiry date from the current anti-siphoning list;
·   it provides that a new anti-siphoning list does not take effect until 6 sitting days of each House of
    Parliament have elapsed.


NOTES ON CLAUSES

Clause 1 - Short Title

This is a formal provision specifying the short title.

Clause 2 - Commencement

The bill provisions are to commence on the day the bill receives Royal Assent.

Clause 3 - Schedules

This clause provides that each Act and instrument that is specified in a Schedule is amended or
repealed as set out in that Schedule, and any other item in a Schedule operates according to its
terms. It also provides that the amendment of any instrument by this bill does not prevent the
Minister from further amending the instrument under section 115 of the Broadcasting Services Act.

 Schedule 1 - Amendments continuing the anti-siphoning list under the Broadcasting Services Act

Item 1

Item 1 inserts a new subsection 2(4) into the Broadcasting Services Act. The new subsection
provides that any changes to a notice under subsection 2(1) (the anti-siphoning list) that has the
effect of removing an event from the notice (2)(4)(a), revoking the notice (2)(4)(b), or placing a time
limit on the operation of the notice (2)(4)(c), will not take effect until 6 sitting days after it has been
tabled in both Houses of Parliament.


Item 2

This item removes the expiry date from the 'anti-siphoning list' at Schedule 2 of the Broadcasting
Services (Events) Notice (No. 1) 2004 to ensure that the list continues in operation until it is replaced.
