ROADS AND JETTIES AMENDMENT (MANAGEMENT OF STATE HIGHWAYS IN CITIES) BILL 2018 BILL 54 OF 2018

                        Roads and Jetties Amendment
                (Management of State Highways in Cities) Bill 2018

As part of its plan to address traffic congestion the State Government has committed to
transfer the sections of Davey and Macquarie Streets that link between the Tasman
Highway and the Southern Outlet from the Hobart City Council to the State Government.

Similarly, the State Government has committed to transfer the sections of Wellington and
Bathurst Streets that link the Midland and East Tamar Highways from the Launceston City
Council to the State Government.

The Roads and Jetties (Management of State Highways in Cities) Amendment Bill 2018 will
enable these transfers and the effective management of the roads subsequently.

The amendments define default maintenance responsibilities between State and local
government for multi-lane one-way roads in an urban area.

A new provision is also included that will allow for agreements between the Minister and
local governments to override the default maintenance responsibilities set out in the Roads
and Jetties Act 1935.

The legislative authority for raising revenue from parking meters is contained in the Local
Government (Highways) Act 1982 and currently applies to local government roads only.

The amendments will allow parking meters to be used on State highways. This means
that the current parking meter arrangements that apply on the roads will not be affected
by the transfer.

The State Government intends to negotiate agreements with the relevant local
governments whereby they will remain responsible for the day-to-day management of
parking controls, including enforcement activities.

Illegally parked vehicles can cause substantial traffic congestion. While the owner of the
vehicle can be fined, this does not resolve the daily congestion being caused. The
amendments create the power to tow away vehicles that have been parked in a location
that is creating congestion or safety issues. The amendments mirror legislation that
already applies on Victorian roads.

This package of legislative amendments has been developed to create an improved
congestion management regime for these important urban highways following their
transfer from local government.
