EDUCATION AND CARE SERVICES NATIONAL LAW AMENDMENT ACT 2017 (NO. 9 OF 2017) - SECT 71

    (1)     In the heading to section 22A of the Children's Services Act 1996 , for " certified supervisors " substitute " nominated supervisors ".

    (2)     In section 22A(1)(a) of the Children's Services Act 1996 omit "or a certified supervisor".

    (3)     After section 22A(1) of the Children's Services Act 1996 insert —

    "(1A)     The Secretary is not required to carry out a fit and proper person check in respect of a nominated supervisor who is nominated by the applicant to manage or control the children's service in the absence of the licensee unless that person is subject to—

        (a)     an undertaking under section 179A of the National Law; or

        (b)     a prohibition notice under section 182(3)(a) of the National Law; or

        (c)     a condition imposed by a prohibition notice under section 182(3)(b) of the National Law.".

    (4)     In section 22A(2) of the Children's Services Act 1996 , after "subsection (1)" insert "or (1A)".
