Victorian Numbered Acts Victorian Numbered Acts(1) Nothing in this Part derogates from any power granted under any other Act to any person to deal with a shipwreck that constitutes an obstruction to the safe and convenient navigation of any Victorian waters or that are situated on shore in any port in the State.
(2) Despite subsection (1), any power referred to in that subsection must not be exercised in relation to a shipwreck unless—
(a) at least 60 days have passed from the date on which that person has given to the Executive Director a notice in writing containing the following particulars—
(i) that person's intention to exercise the power;
(ii) the item in relation to which it is intended to exercise the power;
(iii) the location of that item;
(iv) the nature and extent of the action which is to be taken; or
(b) the item constitutes an imminent
danger to the safe navigation of those waters or is likely to cause damage to
persons or property in a port.
