LEGAL PROFESSION UNIFORM LAW APPLICATION ACT 2014 (NO. 17 OF 2014) - SECT 179

Public Purpose Fund

    (1)     On and after the commencement day all money forming part of the Public Purpose Fund under Division 1 of Part 6.7 of the old Act immediately before that day forms part of the Public Purpose Fund under Part 9 of this Act.

    (2)     On the commencement day—

        (a)     all money standing to the credit of the General Account under section 6.7.3 of the old Act immediately before that day is to be credited to the General Account under section 136 of this Act; and

        (b)     all money standing to the credit of the Statutory Deposit Account under section 6.7.4 of the old Act immediately before that day is to be credited to the Statutory Deposit Account under section 137 of this Act; and

        (c)     all money standing to the credit of the Distribution Account under section 6.7.5 of the old Act immediately before that day is to be credited to the Distribution Account under section 138 of this Act.

    (3)     Any advance paid out of the Public Purpose Fund under section 6.7.9(3) of the old Act before the commencement day that had not been repaid before that day is repayable on or after the commencement day to the Victorian Legal Services Board in accordance with the original terms of the advance and must be paid into the Public Purpose Fund under Part 9 of this Act.

    (4)     If the Attorney-General has given a direction under section 6.7.9(3) or 6.7.10(1A) of the old Act and the Legal Services Board had not complied with the direction before the commencement day, the direction continues in force on and after that day and the Victorian Legal Services Board must pay the money as directed out of the Public Purpose Fund and debit the Distribution Account.

    (5)     On or after the commencement day, the Victorian Legal Services Board may pay out of the Public Purpose Fund (and debit to the General Account) any refund under section 2.4.9(4) or 2.4.11(2) of the old Act in respect of applications referred to in those sections made before the commencement day.

    (6)     For the purposes of section 127(2) of this Act—

        (a)     a reference in that section to an amount previously paid under subsection (1) of that section includes a reference to an amount paid out of the Fidelity Fund into the Public Purpose Fund under section 6.7.21(1) of the old Act; and

        (b)     a reference in that section to the cumulative amount paid into the fidelity fund under section 147 of this Act includes a reference to an amount paid into the Fidelity Fund under section 6.7.13 of the old Act.

    (7)     For the purposes of section 145 of this Act, a reference to an amount previously paid to a person or body includes a reference to an amount paid to the person or body under Division 1 of Part 6.7 of the old Act.

    (8)     Despite anything to the contrary in Division 1 of Part 5 of this Act, and in addition to any other amounts payable from the Public Purpose Fund under this Act, there are to be paid out of that fund, and debited to the General Account, any amounts determined by the Attorney-General for the costs incurred in establishing the Legal Profession Uniform Framework, including costs incurred before the commencement day.
