(1) A person who,
whether as the owner within the meaning of the Road Traffic Act 1974 of
the vehicle or otherwise, uses or permits or authorises the use of a vehicle
to transport dangerous goods commits an offence if —
(a) the
regulations require the vehicle to be licensed to transport the
dangerous goods; and
(b) the
vehicle is not licensed under the regulations.
Penalty:
(a) for
an individual, $50 000 or imprisonment for 2 years or both;
(b) for
a body corporate, $250 000.
(2) A person, other
than the owner within the meaning of the Road Traffic Act 1974 of the
vehicle, who drives a vehicle transporting dangerous goods commits an offence
if —
(a) the
regulations require the vehicle to be licensed to transport the
dangerous goods; and
(b) the
person knows the vehicle is not licensed under the regulations.
Penalty: $10 000.
