(1) The Tribunal may
make a declaration concerning any matter in a proceeding instead of any orders
it could make, or in addition to any orders it makes, in the proceeding.
(2) The
Tribunal’s power to make a declaration under subsection (1) is
exercisable only by a judicial member.
(3) The
Tribunal’s power under this section is in addition to, and does not
limit, any power of the Tribunal under the enabling Act to make a declaration.
(4) The Tribunal may
at any time make any order necessary or desirable to give effect to a
declaration made under subsection (1).
(5) A declaration made
under subsection (1) is binding, according to its terms, on —
(a) the
parties to the proceeding; or
(b) such
of them as are specified in the declaration,
and not otherwise.
