(1) If an inspector
finds a measuring instrument that is being used in contravention of
section 10(1) or (2), the inspector may give to the owner or user of
the measuring instrument a written notice —
(a)
stating that the measuring instrument —
(i)
does not have an inspector’s mark or a
licensee’s mark on it; or
(ii)
for a weighbridge — does not comply with
stated requirements of the regulations relating to weighbridges;
and
(b)
requiring the person to remedy the contravention within a stated period.
(2) The period stated
for the purposes of subsection (1)(b) —
(a) is
generally to be not more than 28 days; but
(b) may
be a longer period, not exceeding 56 days, if the person concerned
satisfies the inspector that special circumstances apply.
(3) The Commissioner
may extend the period specified in a notice given under subsection (1) if
the person concerned applies for an extension before the expiry of the period.
(4) If the person
concerned complies with the notice within —
(a) the
period allowed under subsection (1)(b); or
(b) any
extended period allowed under subsection (3),
the person may not be
prosecuted for an offence against section 10 in relation to the
circumstances to which the notice relates.
